Kevin Fischer is a veteran broadcaster, the recipient of over 150 major journalism awards from the Milwaukee Press Club, the Wisconsin Associated Press, the Northwest Broadcast News Association, the Wisconsin Bar Association, and others. He has been seen and heard on Milwaukee TV and radio stations for over three decades. A longtime aide to state Senate Republicans in the Wisconsin Legislature, Kevin can be seen offering his views on the news on the public affairs program, "InterCHANGE," on Milwaukee Public Television Channel 10, and heard filling in on Newstalk 1130 WISN. click here to take actionRemember when the President said he had a pen and phone and would work around Congress with executive orders and regulations?  He wasn’t kidding, and employers and workers need to beware.

Among the latest end-runs is a regulation put out by the administration’s union allies at the National Labor Relations Board (NLRB).  It’s a rule designed to take away employers’ legal rights, undermine worker privacy, and make it much easier for unions to expand their ranks.  It’s called the “ambush” election rule, and for a good reason.  Here’s what this rule would do:

  • Dramatically shorten the time period for a union organizing election to take place — from an average of 38 days now to as few as 10.
  • Force employers to give union bosses personal information about their employees, such as home phone numbers and e-mail addresses.
  • Allow union elections to take place even when a list of voters hasn’t been completed.

What would the ambush election rule mean for employers and workers?

  • Because of the short election window, workers would no longer get complete information about the advantages — and disadvantages — of joining a union before a vote takes place.
  • Instead, union organizers, who may have been working behind the scenes for months, will provide the bulk of information to workers.
  • Employers would lose the right to bring election challenges to the NLRB after an election takes place.
  • Workers would be subjected to harassing phone calls and e-mails from union organizers.  In addition, unions could retain that personal information — even after an election is over!

Congress must act to stop this rule!  Here are three things they can do:
