State Senator Mary Lazich (R-New Berlin) represents parts of four counties: Milwaukee, Waukesha, Racine, and Walworth. Governor Signs Motor Carrier Indemnification Bill Into Law

Today Governor Walker signed Senate Bill 41 (SB 41), the Motor Carrier Indemnification Bill, into law at a signing ceremony at Schneider Trucking, Green Bay.  I am pleased to be the author of Senate Bill 41 and support the trucking industry and the 200,000 Wisconsin trucking industry employees. 

Under current law, freight carriers may be forced to indemnify, take on liability for the negligence of, the shipper.  Small business trucking companies and independent truckers are forced to either turn away business or take on an unknown liability.  Liability ownership is especially important, since often times the product shipped is flammable or otherwise dangerous.   

Senate Bill 41 protects the public by ensuring that large companies have an incentive to transport quality products with trucking companies of all sizes.  The bill ends the confusion that indemnification clauses cause in the insurance industry.  The bills level the playing field for small business, protect the public from dangerous cargo, and provide certainty for insurance providers.   

With the governor's signature Wisconsin becomes the 28th state to have a law that prohibits indemnity clauses within motor carrier contracts.
